Pipeline company seeks court permission to proceed with plan

All net proceeds from the concert will benefit the Standing Rock Sioux Tribe in its fight against the 1,172-mile, $3.8 billion oil pipeline, which runs from North Dakota to IL and is hung up on a U.S. Army Corps of Engineers easement to cross the Missouri River at Lake Oahe less than a mile north of the reservation.

"Dakota Access Pipeline has been granted every permit, approval, certificate, and right-of-way needed for the pipeline's construction", said Kelcy Warren, CEO of Dakota Access parent company Energy Transfer Partners, in a statement.

But the companies behind the Dakota Access Pipeline slammed the latest decision as "lacking legal or factual justification".

As the protest is stationed in the middle of Market Street between 10th and Van Ness, the SFMTA reports on Twitter that all Market Street Muni lines are stalled.

The companies stated that they would "vigorously pursue its legal rights".

Twenty-eight protesters were arrested near Mandan, North Dakota, after a group of about 400 protesters put a truck and tree branches on BNSF Railway tracks near a pipeline work staging area and tried to set it on fire, Morton County sheriff's spokesman Rob Keller said.

Officers in riot gear responded.

Dakota Access says in court records the delays due to the government's review process have cost the pipeline company hundreds of millions of dollars and will cost the company millions of dollars for each additional month of delay as contractual delivery obligations go unmet.

The decision is a partial victory for the Standing Rock Sioux Tribe.

"As militarized police from more than half a dozen states and Energy Transfer Partners continue to terrorize peaceful water protectors on unceded Native land in North Dakota, groups and individuals across the U.S. and overseas will be targeting the entities responsible for these unconscionable acts of state and corporate violence", organizers said in a prepared statement.

The Army Corps said it plans to get more input from the Standing Rock Sioux in light of the tribe repeatedly being "dispossessed" from its lands in the past.

Construction of the 1,172-mile (1,885-km) pipeline is almost done. The Corps said Monday that it wants to further discuss the pipeline with the Standing Rock Sioux before it decides whether to allow it to cross under a Missouri River reservoir in North Dakota.

Advocates also accused the administration of seeking "death by delay" for the almost 1,200-mile-long project, but are holding out hope the battle will be taken up by Trump, who held massive investments in the DAPL in 2015.

Kennedy is an environmental attorney and president of the New York-based Waterkeeper Alliance, which is an organization that seeks to protect watersheds worldwide.

Activists were calling for nationwide demonstrations Tuesday at Army Corps of Engineers offices and at banks financing the pipeline construction.
