Trump visiting Supreme Court as justices weigh travel ban

Another US appeals court keeps US President Donald Trump's travel ban blocked

President Donald Trump's own tweet regarding his "travel ban" has enabled the court of appeal to obstruct the controversial plan. President Trump has also tweeted that his administration would start implementing tougher vetting measures on those who want to visit United States, adding that the courts are taking the matter too slow.

In a statement, he said: "I am heartened by the decision of the 9th Circuit to maintain the temporary halt implementing certain provisions of the March 6th Executive Order".

The White House delayed the effective date of its revised travel ban to avoid mooting its case as the U.S.

The ruling given on Monday against the travel ban was yet another block against Trump's efforts to prohibit entry of citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen for 90 days while the USA government reviews their screening procedures.

President Trump has promised to take the fight for the travel ban, one of his signature campaign promises, all the way to the Supreme Court. The GBTA recently forecast a $1.3 billion loss in overall travel-related expenditures in the US this year due to the ban, as well as other policies like the proposed expanded laptop ban and other political factors like Brexit. But a party aggrieved by an adverse class certification decision also need not satisfy the strict standards for taking an interlocutory appeal; instead, under Rule 23 (f), a "court of appeal [] may permit an appeal from an order granting or denying class-action certification. if a petition for permission to appeal is filed with the circuit clerk within 14 days after the order is entered".

Trump's latest tweets made it more awkward for Supreme Court justices who might be sympathetic to the president's case to base a ruling purely within the text of the order - no less than George Conway, husband of White House official Kellyanne Conway, wrote in his own recent string of tweets that they make it harder for the administration's lawyers to get to five votes on the Supreme Court.

A panel of judges in San Francisco unanimously upheld a block on implementation of the travel ban without even reaching the question of whether it amounts to unconstitutional religious discrimination.

The government disagreed, arguing that the injunction by Hawaii federal judge Derrick Watson had stopped the clock on the 90-day, six-country and 120-day refugee ban. The Supreme Court is weighing emergency applications in both cases, but is likely to act on them together.

The terms of the revised executive order state that a ban will be applied to travelers from any country that does not cooperate with USA officials to determine whether that country provides sufficient information about its nationals to assure "that the individual seeking the [visa, admission, or other] benefit is who the individual claims to be and is not a security or public-safety threat".

The revised ban suspends travel from six predominantly Muslim countries for 90 days to give the administration time to conduct a review of whether proper vetting procedures are in place to ensure travelers are not a threat to national security.
