Former Milwaukee Officer Found Not Guilty In Shooting Death Of Black Man

Shortly after the verdict, Smith family attorney David Owens said they had filed a lawsuit against Heaggan-Brown and the city.

Prosecutors argued at trial that Smith was defenseless when the second shot was sacked.

The alleged sexual assault occurred on the morning of August 15 after a night of heavy drinking at a bar where the two men "sat and watched television as coverage of the Sherman Park protests [over Smith's death] aired", the criminal complaint said.

Heaggan-Brown shot Smith in August of 2016 after the officer and his partner stopped Smith on the street, suspecting that he was involved in a drug deal. Smith had a gun but had tossed it over a fence just before Heaggan-Brown's second shot hit him in the chest. "And our argument is that justification did not change over the course of 1.69 seconds between shots", defense attorney Jonathan Smith said. "It's a decision the community had to make", Milwaukee County District Attorney John Chisholm said, expressing disappointment over the case.

Former Milwaukee police Officer Dominique Heaggan-Brown appears in Milwaukee County Court on Tuesday.

Heaggan-Brown was sacked from the Milwaukee Police Department in October over a separate matter in which he is facing charges of sexual assault, according to the Journal Sentinel.

Prosecutors argued that it was unnecessary when Heaggan-Brown discharged his weapon a second time. Smith, who was armed with a handgun, ran away from the officers when he saw them exit their squad vehicle. Heaggan-Brown fired the first shot nearly simultaneously with Smith throwing away his gun when he got up.

The shots, 1.7 seconds apart, ended the brief foot chase that lasted 12 seconds.

News of Dominique Heaggan-Brown's acquittal has sparked plenty of reactions on Twitter.

A woman, one of the handful there supporting Heaggan-Brown, stood up and celebrated the verdict, while family members and other supporters of Smith erupted in anger, prompting court security to escort some people out of the courtroom.

"I really don't want them to act irrationally toward the cops, because all cops ain't bad", he said.
