Mexican Man Found Not Guilty of Murder Charges in 2015 Fatal Shooting of Kate Steinle

The shooting happened during the presidential campaign and touched off a fierce debate over the country's immigration policies. Again, I'm not suggesting that necessarily makes the murder, I just don't understand how his handling of the weapon does not make him culpable for her death even if you assume the shooting itself was an accident.

The jury, who had been deliberating since last Tuesday, with a break over the Thanksgiving holiday, sided with the public defender that Jose Ines Garcia Zarate, a Mexican national, accidentally killed Kate Steinle, a 32-year-old East Bay woman who had been out for dinner with her father the night she was shot.

Sessions says San Francisco's "decision to protect criminal aliens led to the preventable and heartbreaking death" of Kate Steinle.

Prosecutors argued that when he shot Steinle, Zarate was "playing his own secret version of Russian roulette".

Since taking office, President Donald Trump's administration has tightened immigration enforcement and warned sanctuary cities they could lose funding if they refuse to cooperate with federal authorities.

"While the State of California sought a murder charge for the man who caused Ms. Steinle's death-a man who would not have been on the streets of San Francisco if the city simply honored an ICE detainer-the people ultimately convicted him of felon in possession of a firearm". He was found guilty on charges of being a felon in possession of a firearm. "It was used to catapult a presidency along that philosophy of hate of others", defense attorney Francisco Ugarte said after the verdict.

Jose Ines Garcia Zarate had been deported five times and was wanted for a sixth deportation when Steinle was fatally shot in the back in 2015.

Garcia Zarate's case triggered national controversy over San Francisco's Sanctuary City policies when it became known that he had been released from city jail several months earlier without notification to federal immigration authorities.

The weapon, as it turned out, had been stolen from a federal Bureau of Land Management ranger a week before. Under local sanctuary city rules, local law enforcement won't hold a person beyond the term of their incarceration.

Before the shooting, Garcia Zarate had finished a federal prison sentence for illegal re-entry into the United States and had been transferred to San Francisco's jail in March 2015 to face a 20-year-old charge for selling marijuana.

The sheriff's department released him a few days later after prosecutors dropped the marijuana charge, despite a request from federal immigration officials to detain him for deportation.

Garcia Zarate, who also used the name Juan Francisco Lopez Sanchez, had been deported five times before the deadly encounter. "It's disconcerting", Brad Steinle told CNN's Anderson Cooper.
